Confidentiality Agreement General Information
 

Charitable Organization "UA MENTAL HELP" CHARITABLE INSTITUTION (hereinafter referred to as the Institution), understanding the importance and necessity of ensuring the confidentiality and inviolability of Personal Data of individuals, enters into this Confidentiality Agreement (hereinafter referred to as the "Agreement") with You (hereinafter referred to as the "User") to establish the procedure for obtaining, storing, processing, using, and disclosing the User's Personal Data by the Institution when the User utilizes the Institution's capabilities for attracting and providing charitable assistance through the website http://uamentalhelp.org (hereinafter referred to as the "Site").
 

Terms of Use of the Site
 

The condition for using the Site for the User is the full acceptance of the provisions of this Agreement. The User is deprived of the right to use the Site and the capabilities for attracting and providing charitable assistance offered by the Site (hereinafter referred to as the "Capabilities") in the absence of their consent to the terms of this Agreement.
 

Users' Agreement
 

Site users agree that, for the purpose of complying with the requirements of the Law of Ukraine "On Protection of Personal Data", the Institution has the right to include the personal data provided by users into the personal data database, to process such personal data and, if necessary, due to the fulfillment of the requirements of the aforementioned law, to transfer such personal data to third parties.
 

Definitions
 

Personal Data - Information about a specific User that allows identifying this User as an individual.

Public Data - Information (including Personal Data) that an individual - the owner of this data, has provided access to an unlimited circle of persons (including by publishing on any website without restricting access to this data) or that, according to this Agreement and/or the current legislation of Ukraine, is not subject to confidentiality requirements.

 

Account -  A set of information about the User, containing the User's authorization data (login and password) necessary for identifying the User when using the Site and Services.

 

Cookies - A fragment of data created by the Site and stored on the User's computer in the form of one or more files. Cookies do not contain Personal Data and can be blocked by the User at any time.

1. Subject of the Agreement

1.1. This Agreement determines the procedure for obtaining, storing, processing, using, and disclosing Personal, Public, and other data provided to the Institution by the User when using the Site and the Capabilities.

1.2. By using any part of the Site and the Capabilities, the User grants the Institution the right to obtain, store, process, use, and disclose the User's Personal Data under the terms of this Agreement.

1.3. This Agreement does not regulate and the Institution is not responsible for the procedure of obtaining, storing, processing, using, and disclosing the User's Personal Data by third-party companies and organizations that are not owned or controlled by the Institution, and by individuals who are not employees of the Institution, even if the User accessed these individuals' websites, software, goods, or services through the Site.

1.4. The purpose of obtaining, storing, processing, and using the User's Personal, Public, and other data is to protect the interests of the User and the Site, as well as to provide the User with Capabilities, including displaying targeted, personalized, or general information, improving the quality of existing and creating new websites and capabilities provided by the Site.

2. Collection, Processing, and Use of Information

2.1. When creating an Account, the User must provide authorization data, as well as their first name, last name, public name, email address, and other data. After the creation and use of the Account by the User, the Institution gains the ability to identify the User each time they use the Site.

2.2. The Institution has the right to upload Cookie files to Users' computers (unless the User has independently restricted this option in their web browser), as well as to receive, store, process, and use the information contained in Cookies.

2.3. When the User utilizes the Site and its Capabilities, the equipment on which the Site is located automatically stores, processes, and uses data about the User that does not relate to Personal Data, such as: the User's IP address, geolocation data - information about the User's location that can be determined through their IP address, UTM parameters, the technical parameters of the User's computer, the presence or absence of specific software on the User's computer, the settings of this software, Cookies, as well as statistical information about the User's activity.

2.4. The Institution has the right to store the User's Personal, Public, and other data for the duration and to the extent necessary to achieve the purpose outlined in this Agreement, or for the periods established by the current legislation of Ukraine, international law standards, or the legislation of the User's country of residence or stay, or until the User deletes these data.

2.5. In the event of a change in Personal Data, the User must provide the Institution with updated data by making the corresponding changes to their Account on the Site. If the User fails to comply with this requirement, the Institution is not responsible for any adverse consequences related to the processing of such Personal Data.

3. Access to Information

3.1. The Institution undertakes not to provide Personal Data to third parties for commercial purposes without the consent of the User to whom these data belong. The transfer of Personal Data to third parties for the purpose of carrying out the Institution's statutory activities and fulfilling our obligations under executed transactions is allowed in the following cases:

- After obtaining the User's consent to whom the information belongs;

 

- When it is necessary to transfer Personal Data to fulfill obligations, carry out the statutory activities of uamentalhelp.org, or at the User's request;

 

- Upon justified requests from state authorities authorized to receive such data;

 

- In cases where, in the Institution's opinion, the User violates the terms of this Agreement and/or other agreements and contracts between the Institution and the User.

 

3.2. The User allows the Institution to grant permission to other companies with which the Institution has executed relevant agreements to receive, store, and process data about the User (excluding Personal Data), such as the User's IP address, Cookies, as well as statistical information about the User's activity to improve the quality of services provided by these companies and advertising information.

 

3.3. The User agrees that the confidentiality of data transmitted over the Internet is not guaranteed and in the event that access to these data is obtained by third parties outside the zone of technical communication means controlled by the Institution, the Institution is not responsible for the damage caused by such access.

 

3.4. The User has the right to request, change, or delete their Personal Data accessible to the Institution. To do this, the User must submit a corresponding request by sending it to the contact address support@uamentalhelp.org, unless another independent method of requesting, changing, or deleting Personal Data is provided by the Site's technical capabilities. The subject of the email should indicate "Deletion / change of personal data," and the body should include the User's contact information and user identifier on the Institution's platform.

 

4. Additional Conditions

 

4.1. The Institution has the right to make changes to this Privacy Agreement. All changes made to the Agreement will be available in the form of a new version of the Agreement at the address http://uamentalhelp.org/privacy-policy, and in the case of significant changes to the Agreement, the Institution will additionally notify the User of these changes via the email specified in the User's Account. All changes to the Agreement take effect from the moment of their publication. By using the Capabilities or the Site, the User confirms their agreement with the new terms of the Agreement in the version that is in effect at the time the User uses the Capabilities and/or the Site.

 

4.2. The Institution is not responsible for any harm or damage that the User or third parties may suffer as a result of a misunderstanding or misinterpretation of the terms of this Agreement, instructions, or guidelines on the use of the Site, data placement procedures, and other technical issues. Before accepting the terms of this Agreement, any User has the right to contact the Institution for clarification of the provisions of the Agreement.

 

4.3. If any part of this Agreement is found to be invalid or unenforceable, the other parts of the Agreement will remain in effect. The waiver by either party of any provision or condition of this Agreement, or any breach thereof, does not invalidate the provision or condition.

 

4.4. The legislation of Ukraine applies to this Agreement and the relationship between the Institution and the User that arises in connection with the use of the Site. Each party irrevocably agrees that the appropriate courts of Ukraine have exclusive jurisdiction over any claims, disputes, or disagreements related to the Agreement and the use of the Site.

 

5. Your Rights

 

Under the Law of Ukraine "On Protection of Personal Data", you have the right to:

- Know the sources of the collection, the location of your personal data, the purpose of their processing, the location or residence (place of stay) of the owner or manager of personal data, or give an appropriate order to obtain this information to authorized persons, except in cases established by law.

 

-Receive information about the conditions for granting access to personal data, including information about third parties to whom your personal data is transferred.

 

- Access your personal data.

 

- Receive, no later than thirty calendar days from the date of the request, except in cases provided by law, a response as to whether your personal data is being processed, as well as receive the content of such personal data.

 

- Submit a reasoned request to the owner of personal data with an objection to the processing of your personal data.

 

- Submit a reasoned request for the change or destruction of your personal data by any owner and manager of personal data, if these data are processed illegally or are inaccurate.

 

- Protect your personal data from unlawful processing and accidental loss, destruction, damage in connection with the intentional concealment, failure to provide or untimely provision, as well as protection from providing information that is inaccurate or discredits the honor, dignity, and business reputation of an individual.

 

- File complaints about the processing of your personal data to The Ukrainian Parliament Commissioner for Human Rights (Ombudsman) or to the court as specified in this agreement.

 

- Apply legal remedies in case of violation of the legislation on personal data protection.

 

- Make reservations about restricting the right to process your personal data while giving consent.

 

- Withdraw consent to the processing of personal data.

 

- Know the mechanism of automated processing of personal data.

 

- Protect against an automated decision that has legal consequences for you.

 

If you are located in the EU, under GDPR you have the right to:

- Request access to your personal data that we store, their deletion, or correction.

 

- Be informed about the processing of your personal data.

 

- Restrict the processing of your personal data.

 

- Portability of your personal data.

 

- Object to the processing of your personal data.

 

- File a complaint with the relevant supervisory authority.

 

6. Amendments

We may make changes to this agreement. Please check this agreement from time to time at http://uamentalhelp.org/privacy-policy.
